JUDGMENT : 1. The petitioner has filed an affidavit verified on September 1, 1995 stating therein that he had not instructed anybody to approach one of us (K. Ramaswamy, J.) to favourably dispose of his review petition. He has further stated that: .......I am shocked to hear this as I have not authorised anybody to approach your Lordships nor it was ever my intention to approach your Lordships except in accordance with procedure established by law, nor do I have any knowledge of anybody having approached your Lordships. I am totally in dark and ignorant of anybody doing such indiscreet act." 2. Yesterday, i.e., on 31st August, 1995, at around 7.'O' Clock in the morning, one Mr. S. Swatantra Rao, an I.A.S. Officer of Karnataka Cadre who happened to be an inmate, along with K. Ramaswamy, J., of B. Govinda Reddy Hostel at Muruteru in West Godawari District of Andhra Pradesh, rang up the residential office of K. Ramaswamy, J. Both of them had parted ways from that hostel in 1954 and thereafter, they never met together. Sri Swatantra Rao sought to meet K. Ramaswamy, J., who replied that it being morning time it was not possible to spend time with him and requested Sri Swatantra Rao to meet him at his residence in the evening after 6.00 'O' Clock. Sri Swatantra Rao, however, requested to permit him to meet in the morning itself since he had to leave for Bangalore in the evening. Accordingly, he was given time to meet at 8.00 a.m. Sri Swatantra Rao arrived at 8.00 a.m. After reminiscing the days spent in the hostel and the events which had taken place in between, i.e., from 1954 till date he requested to permit him to present the film which he had made on Dr. Ambedkar and a copy of the cassette was given. Thereafter, when the Judge stated that he had got work, he sought permission to mention a matter. Then K. Ramaswamy, J. asked him whether it was administrative or judicial matter. Sri Swatantra Rao stated that it was a judicial matter. Then K. Ramaswamy, J. cautioned him that it was highly improper to.mention about judicial matters. In spite of the caution, he mentioned that the matter at hand was coming up for review. K. Ramaswamy, J. took a serious view of the matter and thereon Sri Swatantra Rao expressed apology and left the place. Then K. Since this allegation has now been denied, Registry is directed to summon Sri Swatantra Rao, presently Managing Director, Mysore Acetates & Chemicals Ltd., to appear before the Court on Friday, the 8th September, 1995 to record his evidence. 4. Implementation of the order dated 25th August, 1995 imposing sentence on the petitioner is postponed for one week. 5. Post the I.A. on Friday, the 8th September, 1995 at 10.30 a.m.
