JUDGMENT : 1. The petitioner has stated in the review petition that a criminal complaint, alleging that the petitioner has committed an offence under Section 494 Indian Penal Code, has been filed against him by his first wife before the Chief Judicial Magistrate, Barasat. According to the petitioner, at the time when he married for the second time after conversion to Islam, he could not be prosecuted under Section 494 I.P.C. in view of the law prevailing at that time. It is stated that in view of Act 20(1) of the Constitution of India the petitioner cannot be prosecuted for an offence which was not in force at the time of the commission of the Act charged as an offence. 2. Notice, limited to the question of Article 20(1) of the Constitution of India.
