JUDGMENT 1. - Gurdeep Singh has taken this revision petition against the appellate judgment dated 28.9.1995 passed by the learned Addl. Sessions Judge No. 1, Sri Ganganagar whereby he dismissed the appeal filed against the conviction under Section 54 (A) & (D) of the Rajasthan Excise Act and sentenced to six months simple imprisonment and fine of Rs. 100/-. 2. The learned Public Prosecutor is present in Court and he has accepted the notice. On the request of the learned counsel appearing for the parties, this revision petition is disposed of finally at the admission stage. 3. The case against the petitioner is that on 12.7.1986 he was found to carry a `Jarikan' having illicit liquor therein and that seeing the excise party he ran away leaving the Jarikan and when thereafter his house was searched, a drum full of wash was also found. A charge under Section 54 (A) & (D), Raj. Excise Act was framed against the petitioner. The prosecution examined six witnesses. The accused-petitioner denied that he committed any offence. The learned Magistrate, after considering the evidence and hearing the parties, convicted the petitioner. 4. I have read the judgments of the Courts below. There is a detailed discussion of the evidence in the judgment of the trial Court. 5. The learned counsel for the petitioner has not challenged the conviction of the petitioner on merits. He has prayed that the sentence of the petitioner be reduced to the period already undergone. The learned Public Prosecutor has got no objection since the petitioner has already suffered two months imprisonment. 6. Considering the fact that this is the first offence of the petitioner, I deem it proper to reduce the sentence of the petitioner to the period already undergone by him. 7. Consequently, this revision petition is partly allowed and while maintaining the conviction of the petitioner, the sentence is reduced to the period already undergone. Let the Jail Authorities be informed that if the petitioner is not required in any other case, he may be released forthwith.Revision Partly Accepted. *******
