Order Heard learned counsel for the parties and considered the materials on record. This writ petition is being disposed of at the stage of admission itself by passing the following order : 2. In this writ petition, the petitioner has prayed for issuance of a writ of mandamus commanding the respondents to pay the amount of Rs. 2,00,365/- along with Interest at the rate of 18 percent per annum. The petitioner asserts that the said amount is due to him and should be paid to him by the respondents for the repairing of the right hand side track of Dozer, Sproket of Dozer, left hand side and Compressor of Barnar Dam at Batia in the district of Jamui. According to the assertion of the petitioner the said work was completed within the stipulated time i.e. on 4-4-1992 but the money has not been paid to him so far. 3. In this proceeding a counter affidavit has been affirmed by the Executive Engineer, Irrigation Mechanical Division (Jamui) and in paragraph 3 of the said counter affidavit he has admitted that the total amount of Rs. 1,43,340/- is due to the petitioner. 4. In that view of the matter, respondent no. 2 is directed to release the aforesaid amount of Rs. 1,43, 340/- for being paid to the petitioner by respondent no. 6. Such payment must be made by the concerned respondents within a period of eight weeks from the date of receipt/production of copy of this order. It is made clear that in respect of the balance amount the petitioner is entitled to make a representation giving all details before respondent no. 2 within a period of three weeks from today and if such a representation is made, respondent no. 2 will consider the same and pass a speaking order in accordance with law within a period of four weeks from the date of filing of the representation. If it is found by the respondents that the balance amount is payable to the petitioner then that should also be paid within two weeks thereafter. 5. It is further made clear that if the aforesaid amount of Rs.

With the above direction, this application is disposed of. There will be no order as to cost.
