ORDER : 1. Kashi Nath Dutta & Tushar Kanti Nag, respondents in the appeals herein, are employed with the Government-Mint. They are also in occupation of official quarters. They filed a claim under Section 33 (c) (2) of the Industrial Disputes Act, t947 before the Labour Court, for calculating their over-time wages on the basis of their basic wages plus the house rent allowance to which they have been entitled to, had they not occupied the Government quarters. Their claim was allowed by the Labour Court. 2. We have heard learned counsel for the parties. In view of the Judgment of this Court in Govind Bapu Salvi & Ors. v. Viswanath Janardhan Joshi & Ors., 1995 Supp. (1) SCC 148, these appeals have to be allowed. Under similar circumstances this Court has held that an employee of the Mint who is in occupation of Government quarter is not entitled to add the House Rent Allowance, notionally, to his wages, for computing the over-time allowance. 3. The appeal is allowed. We set aside the impugned Judgment of the Labour Court. No costs.
