Omkar Prasad Shukla v. State of U. P.

1995-01-19

FAIZAN UDDIN, S.C.AGRAWAL

body1995
ORDER : From the counter-affidavit filed on behalf of the respondent it appears that the petitioner had been sent on deputation to the U. P. Forest Corporation on April 9, 1991. The said deputation was for a period of three years and the said period was completed on April 8, 1994. The period of deputation could be extended for a further period of two years but no order for extension has been passed. Since the original period of deputation has already expired the questions raised by the petitioner in this special leave petition have become purely of academic importance and no useful purpose will be served by perusing the matter. In these circumstances, the special leave petition is dismissed. It is, however, directed that the petitioner will be paid his salary till the date of this order. The salary for the period up to April 22, 1994 will be payable by the U.P. Forest Corporation and for the subsequent period the same shall be paid to him from the office of Chief Conservator of Forests, Allahabad. The petitioner shall join duty in the office of Chief Conservator of Forests, Allahabad within a week from the date of the order. Petition dismissed.
