JUDGMENT : 1. The petitioner has sought a direction to the Union of India through Archaeological Survey of India and State of Uttar Pradesh to preserve, protect and repair the Dargah and Shrine of Sheikh Salim Chisti at Fatehpur Sikri (Agra) which is a world heritage and has been declared to be a national monument. Learned counsel for the Archaelogical Survey of India states that since the management of the Dargah has rented out part of the premises to shopkeepers they may cause obstruction in carrying on the necessary repairs. Mr. H N Salve, learned counsel appearing for the Waqf Board states that the Board shall have the shops vacated, if necessary, to facilitate the repair-work. The Director General may start the repair work with effect from January 1, 1996. The Director General shall file an affidavit in this Court by April 30, 1996 indicating the extent and progress of the repairs done. We record the Undertaking of the Board through Mr. H N Salve that the Board shall render all assistance to the Director General in carrying on the repair work. List on 6.5.1996.
