JUDGMENT : 1. Pursuant to the show cause notice issued by this Court's order dated September 11, 1995. Mr. K.S. Ramesh has filed affidavit. Mr. Ramesh is also present in Court. He has categorically denied all the allegations which have been made against him in the affidavit filed by Mr. C. Dinakar, Additional Director General of Police, C.O.D. We do not wish to go into the correctness of either of the affidavits. We are satisfied that show cause notice issued to Mr. Ramesh be discharged. We order accordingly. I.A. No. 37/95: 2. Mr. Chandershekhariah, learned counsel appearing for the State of Karnataka, states that investigation relating to Crime No. 304/94, registered at Police Station K.G. Hali has been completed. According to the learned counsel the charge sheet against the accused in the said case is to be filed in the Court. Pursuant to this Court's order dated September 28, 1995, the CBI is holding investigation against the persons who were named in the statement of Mrs. Tulsi Rajasekhar, wife of Dr. Pennathur. Mr. K.L. Sudheer, SP, COD, who is present in Court states that all the necessary papers have been handed over to the CBI. We direct the COD to file the charge sheet so far as Crime No. 304/94 is concerned against the accused persons in that case. After filing the charge sheet the said case be handed over to the CBI. The CBI may on the basis of the investigation conducted by it file a supplementary charge sheet against the persons under investigation, if necessary. As directed by us in our order dated September 28, 1995 Mr.C. Dinakar, Additional Director General of Police, COD, Bangalore and Mr. RA Benakop, DSP, COD, Bangalore shall continue to associate themselves with the CBI in the investigation. The I.A. is disposed of. Dr. Pennathur has been produced in this Court. He be taken back to the judicial custody. I.A. No. 36/95: 3. Issue notice to the State of Karnataka. The State may file a short affidavit within two weeks. To be listed on 15th January, 1996. Cont. P. 373 of 1995: 4. The contempt petition is permitted to be withdrawn at this stage.
