JUDGMENT : 1. An incident which should shock the conscious of every law abiding person is alleged to have taken place within the Pilibhit Jail in which 7 inmates were brutally murdered and 28 others were injured, 9 out of them having suffered serious injuries. The perpetrators of the said crime are stated to be the wardens and members of the jail staff. The Government of U.P. instituted as many as three inquires, namely, (1) A Magisterial inquiry (2) An inquiry by the C.I.D., U.P., and (3) An inquiry by a High Powered Committee headed by the I.G. of Prisons, U.P. The reports of the three Committees are not before us but counsel for the State informs us that in the 1st and 3rd inquiry reports excessive use of force has been established while in the 2nd, the inquiry report suggests commission of crimes like murder, etc. Consequently, prosecution has been lodged against 37 alleged offenders. We would like to peruse all the three reports. We would also like to peruse the First Information Report that may have been filed and the offences, if any, registered against the offenders and if any charge-sheet is filed, a copy of the charge-sheet. Let this matter come up on 30th January, 1995 along with Writ Petitions (Cr1.) Nos. 364-376/98.
