JUDGMENT : Slaughter House Matter 1. Mr. Hemendra Kumar, Joint Secretary, Ministry of Agriculture is personally present in Court. We have discussed the project with him. Mr. Altaf Ahmad, learned Additional Solicitor General has suggested that inviting tenders for completing the project on turn key basis would be more viable so far as time schedule is concerned. This - is a matter for the Ministry to examine. We give two week's time to the Ministry for planning and preparing the project. While hearing the arguments on the question of re-location of industries from the Agra Trapezium, it has been brought to our notice that about 14,000 trucks carrying about 64,000 tonnes of weight pass through the city of Agra every day. According to the Experts, the passage of such a large number of trucks through the city of Agra every day causes huge lot of pollution. It has been suggested by various authorities including the Agra Heritage Project that it is of utmost urgency that a bye-pass be constructed for diverting the traffic from the city of Agra. Realising the importance of the project, we requested some responsible officers from the Public Works Department (B&R) to be present in Court and assist us. Mr. Mahinder Pal, Executive Engineer concerned is present in Court. Mr. Srivastava, learned counsel for the State of U.P. has placed on record Sketch Plan showing the proposed construction of Agra Bye-pass. It is stated that distance from point Runkada on the Delhi-Agra road up to point B3, which is on Agra- Bombay-Gwalior read, via B 1 canal, is about 24 Kms. If this part of the Bye- pass is constructed, almost 50% of the traffic can be diverted. It is stated by Mr. Srivastava that the work for the construction of this part of the Bye-pass is already in progress. He further states that due to paucity of funds, it may not be possible to complete the construction of this part for another 2/3 years. 6. We are of the view that the above mentioned part of Bye-pass should be completed within six months. We direct the Joint Secretary, Public Works Department and the Chief Engineer, P.W.D. (B&R) to give their response to our tentative suggestion by way of an affidavit in this Court. They may indicate the difficulties which are likely to come in their way in completing the project in six months. 7. To come up on March 12, 1996.
