ORDER : 1. We have elaborately heard the learned counsel for the State of Tamil Nadu and Karnataka and given our anxious consideration to the very urgency problem. 2. Having regard to the facts and circumstances of the case, we are of the considered view that the implementation of the Cauveri Water Tribunal's order dated December 19, 1995 to release 11 TMC water may be implemented by finding a solution as under : 3. In view of the letters written by the respective Chief Ministers to the Prime Minister for his intervention, Hon'ble the Prime Minister, Shri P.V. Narsimha Rao is requested to convene, as expeditiously as possible within two days from today, a meeting of the Chief Minister Tamil Nadu, Chief Minister Karnataka, the respective floor leaders of all political parties and opposition leaders in the Legislative Assemblies of the State of Tamil Nadu and Karnataka as well as the Members of the Parliament hailing from the Mittur resorvoir Ayecut of Tamil Nadu and the counter-part area in Karnataka. 4. In the said meeting, it would be open to the respective representatives of States to foot-forth their views in a constructive way to find an amieable solution. As a result of the consultation with the above respective representatives and the Chief Ministers of respective States, the Prime Minister may evolve a solution either on consensus or by his own decision, to release water immediately to have the standing crops in Mittur Ayecut area of Tamil Nadu from being withered way, while preserving the standing crops in Karnataka Ayecut so as to save national food production. This order will he till the disposal of the suit by this Court which is posted to February 6, 1996. 5. We hope and trust that the respective leaders would raise above levels and act in statesmanship in assisting the Prime Minister to find the solution for releasing the water pending the suit so that the solution would generate a sense of amity and cordiality between citizens in the respective States. 6. Registry is directed to communicate this order immediately to the Cabinet Secretary to Government of India for taking immediate action.
