N. P. SINGH, J. ( 1 ) THAT, he is facing trial before the learned Judicial Magistrate, First Class, Umaria, vide Cr. Case No. 362/93 under Section 327 of the Indian Penal Code. Because of his absence on the date of his appearance, he has been arrested and remanded to judicial custody on 20-1-1995. Matter his aforesaid arrest the applicant submitted an application for grant of bail which has been rejected by the learned M8gistrate. ( 2 ) MR. S. L. Kochar for the applicant and Mr. S. K. Gangrade, P. L. , for the State. They are heard on the application for grant of regular bail to the applicant who is accused of an offence under Section 327 I. P. C. ( 3 ) THE counsel for the applicant has contended that the applicant was granted bail on merit and he was regularly attending the Court, the applicant could not attend the Court on account of wrong date given by his counsel. ( 4 ) IT appears that the applicant has been apprehended on 20-1-1995 and since then he is in- judicial custody. I think the applicant has been sufficiently penalised for the misuse of the privilege of bail. The counsel for the applicant has contended that the applicant undertakes to appear in Court regularly and he will not misuse the privilege of bail and will also co-operate with the trial. ( 5 ) IN view of the submission of the learned counsel, no further detention of the applicant appears to be necessary at this stage. ( 6 ) ACCORDINGLY it is directed that the applicant be enraged on bail of Rs. 5000/- with one surety in the like amount to the satisfaction of the Trial Magistrate. Application allowed. .
