N. N. MATHUR, J. ( 1 ) SECTION 15 (5) of the Payment of Wages Act, 1936, as applicable in the State of gujarat, provides that:"any amount directed to be paid under this section may be recovered by the authority as an arrear of land revenue and authority shall, for that purpose, be deemed to be a public officer within the meaning of Sec. 5 of the Revenue Recovery Act, 1890. " ( 2 ) THUS, there is a specific remedy provided under the statute itself for recovery of the amount. Way back in 1965 the Apex Court, in its decision reported in AIR 1965 SC 745 has held as under :"we ought never to forget that the power to punish for contempt, large as it is, must always be exercised cautiosly, wisely and with circumspection. Fresh or indiscriminate use of their power in anger or irritation would not help to sustain the dignity or status of the courts. " ( 3 ) XXX xxx xxx. .
