JUDGMENT : Thomas, J. The subsisting grievance of the appellant is, though the learned single Judge passed a direction to the Central Government that Ext. P1 shall be considered and disposed of as expeditiously as possible, what should be done during the interregnum has not been provided. It is suggested by the learned single Judge that appellant should get his visa extended in the meanwhile. 2. This is a case where the appellant claimed Indian Citizenship and wanted determination of his citizenship under Section 9(2) of the Indian Citizenship Act (for short 'the Act'). The only authority which can determine the status as an Indian Citizen is the Central Government. That legal position is now well settled with the repeated decisions of the Constitution Bench of the Supreme Court vide Izhar Admad v. Union of India, AIR 1962 SC 1052 and in Govt. of Andhra Pradesh v. Syed Mohd. Khan, AIR 1962 SC 1778 . It was followed in Md. Ayub Khan v. Commissioner of Police, AIR 1965 SC 1623 and in State of U.P. v. Rahmatullah AIR 1972 SC 1382. It is a different matter that the appellant is the holder of a Pakistani Passport for urging the Central Government to determine his citizenship once he claims Indian Citizenship and makes a representation under Section 9(2) of the Act. We do not think that in the present circumstances we can urge the appellant to get his visa extended because appellant now claims to be an Indian Citizen albeit his holding a Pakistani Passport. So the position is that until the citizenship claimed by him is determined under Section 9(2) of the Act he cannot be pushed out of Indian or deported into Pakistan against his wish. 3. At the same time, we cannot allow the appellant to go unnoticed without any surveillance. We, therefore, injunct the respondents from deporting the appellant to Pakistan until a decision is taken on Ext. P1 representation. This direction is subject to a condition imposed on the appellant that he should report to the Superintendent of Police, Kannur on all first Mondays in alternate months, uptil further orders from this Court. 4. Writ Appeal is disposed of as above. 5. Issue photocopy on usual terms.
