JUDGMENT This petition has been preferred under section 482, Cr.P.C. by the petitioners for seeking the quashing of the proceedings pending in the Court below. The grounds raised are that the complaint is false and frivolous and that the process of the Court is being misused, and instead of prosecution, it has turned out to persecution, and therefore, it is submitted that the proceedings deserve to be quashed. The record from the Court below was also called for. From the perusal of the record, it appears that the complainant has tried to drag the proceedings, but the petitioners are also not wholly innocent; at times, they have also contributed to the pendency of the proceedings. However, at this stage, I do not deem it proper to go into the details of the controversy. With regard to the other contention, since the Court below has fixed the case for hearing arguments on charge, it would not be proper to make any comments in that regard. If as contended by the petitioners, there is only one set of the witnesses with the complainant, which is being introduced in every case, it is for the petitioners to advance the arguments before the Court below and not in this Court for the first time. From the perusal of the last ordersheet, which appears to be of 29.4.95, it appears that the learned C.J.M., Gwalior, has fixed the case for further orders on 7.7.95. Since all parties are present in Court today, the facts of the case in the interest of justice demand that the learned C.J.M., Gwalior, be directed to take up the matter at some early date for hearing parties on the question of framing of the charge. It is, therefore, directed that the parties shall appear in the Court of C.J.M., Gwalior, on 15.5.95, and on that date, the learned C.J.M., Gwalior, shall hear the parties without allowing any time for arguments on charge and the order in that regard shall be passed within next two days. It further appears from the perusal of the record that some of the accused persons are of advance age. The learned Magistrate may exempt them from personal appearance. The petition is finally disposed of.
