JUDGMENT 1. - Heard. Perused the order-sheets of the file of Committing Magistrate as also those of the file of the learned Additional Sessions Judge, Ratangarh. 2. Petitioner Jassuram was granted anticipatory bail by the learned Additional Sessions Judge in Crime No. 104/93, Police Station Chhappar, District Churu for the offences under sections 147, 148, 307, 323 read with 149 IPC. After completion of the investigation the challan was filed in the Court of learned M.J.M., Sujjangarh, however he did not appear in the Court because he had already gone to Saudi Arabia to earn his livelihood. The petitioner's bail bonds were forfeited by the Committing Magistrate and proceedings under sections 82 & 83 Criminal Procedure Code were also initiated. The Committing Magistrate committed the case by his order dated 10.6.94. In this case besides the petitioner there are 13 co-accused persons, who are appearing in the Court. The petitioner surrendered in the Court of learned Additional Sessions Judge on 8.5.95 and submitted his bail application, which was rejected by the Sessions Judge by his order dated 9.5.95. 3. Mr. Khatri submits that the petitioner shall now regularly attend the Court and that since the Visa was granted in his favour, he had gone to Saudi Arabia to earn his livelihood. In this case all other co-accused persons are on bail. Therefore, keeping in view all the facts and circumstances of this case, I feel that it will be just and proper to grant bail to the petitioner. 4. Accordingly this bail petition is allowed and it is ordered that petitioner Jassuram be released on bail provided he executes his personal bond for a sum of Rs. 10,000/- (Rs. ten thousand) and furnishes two sound and substantial sureties for a sum of Rs. 5,000/- each to the satisfaction of the learned Additional Sessions Judge, Ratangarh for his regular appearance before him in the Sessions Case No. 98/94 on each and every date of hearing and whenever ordered to do so.Bail granted. *******
