Judgment P.K.Deb, J. 1. Heard Mr. R. S. P. Sinha, learned counsel for the petitioner and also heard Mr. K. K. Jhunjhunwala, learned Additional Public Prosecutor, for the State. 2. Earlier the petitioner came up before this Court in Cr. Misc. No. 108 of 1995 (R) wherein prayer for bail was rejected by this Court vide order dated 17-1-1995, but liberty was given to the petitioner to renew his prayer after 30-6-1995. 3. According to the petitioner, he filed another petition vide Crl. Misc. No. 2873 of 1995 (R) on 31-7-1995 and it appears that by order dated 7-8-1995, prayer for bail was rejected, but it is the submission of Mr. Sinha, learned counsel for the petitioner that in fact the prayer for bail of this petitioner was granted by brother Ganguli, J., but it was wrongly recorded by his Stenographer as "rejected. 4. Mr. Sinha then filed an affidavit before a Division Bench for redressal of his grievance, but it is stated at the Bar that he was directed to file a fresh bail petition. 5. I have ascertained the fact from the Bench Assistant wherein he recorded in the progress report that bail was granted to the petitioner vide order dated 7-8-1995 in Cr. Misc. No. 2873 of 1995 (R), Mr. K. K.Jhunjhunwala, who appeared on Additional Public Prosecutor, for and on behalf of the State in that bail petition also confirmad that ball was granted to the petitioner and he had mentioned accordingly in the brief cover of the case. 6. Considering all the facts, prayer for bail of this petitioner (Sarju Yadav) is allowed. The petitioner is admitted to go on bail on furnishing bail bond of rupees ten thousand with two sureties of the like amount each, to the satisfaction of the Chief Judicial Magistrate, Chatra, in connection with Basist Nagar P. S. Case No 66 of 1994.
