JUDGMENT 1. - Heard learned counsel for the petitioner and learned P.P. for the State. Order of the learned Addl. Sessions Judge perused. 2. The grievance of the petitioner is that when the bail application is moved the Investigating Agency comes with the case that they do not want to arrest, but subsequently, they do not abide by their stand and arrest is made by them. Learned counsel contended that the nephew of the petitioner, Nihal Singh, has been arrested forcible. From the order of the learned Addl. Sessions Judge it appears that the petitioner is not required to be arrested in the case. 3. Though, the application is premature, but taking into consideration all the facts and circumstances, I think it proper to give a direction to the Investigating Officer/Police Officer that subsequently if they desire to arrest the petitioner, they shall give a notice of 7 days prior to their arrest so that the petitioners may approach to the concerned Court to seek remedy of bail. 4. A copy of this order be sent to the S.H.O. Police Station, Nagar, Bharatpur for compliance.The application is disposed of as indicated above.Petition disposed of. *******
