JUDGMENT 1. - Heard learned counsel for the petitioner and learned PR for the State. 2. It is contended by the learned counsel that bionorphine injections recovered from the petitioner have been manufactured by Company legally authorised to manufacture the same. It was also contended that the said injection is not covered undet the N.D.RS. Act. It was also contended by the learned counsel that the petitioner has licence under the Drugs and Cosmetic Rules, 1945 to sell, stock or exhibit for sale the drugs under the said licence. 3. The report of the F.S.L. is still awaited. However, taking into consideration all the facts and circumstances and the contents of the injections as noted on it, I am inclined to release the petitioner on bail under section 439 Cr.RC. 4. It is, therefore, ordered that the petitioner Raj Kumar S/o Khattan Mai shall be released on bail, provided, he furnishes personal bond in the sum of Rs. 10,000/- with two sureties in the sum of Rs. 5,000/- each to the satisfaction of the trial Court, i.e. Special Judge, NDPS Act Cases (Addl. Sessions Judge No. 1) Kota, for his appearance in court or any other court during trial/inquiry/investigation as the cast may be. *******
