JUDGMENT 1. - This revision petition has been filed by Maluk Khan against the judgment of the learned Sessions Judge, Jaisalmer dated 21.11.94 whereby he dismissed his appeal against the order passed by the C.J.M., Jaisalmer on 23.3.94 convicting him under Rule 3 read with Rule 6 of the Passport (Entry in India) Rules, 1950 and sentencing him two months' S.I. 2. The case has been finally heard on the request of learned counsel for the parties. 3. Learned counsel for the petitioner submitted that he does not challenge the conviction recorded by the learned C.J.M. He only submits that the petitioner has already remained in jail for about 28 days and this should be considered sufficient punishment in this case. He has placed reliance on the cases: State v. Krishna, 1987 RCC 517 and Balia v. State of Rajasthan, 1995 Cr.L.R. (Raj.) 126 . Learned P.P. has not opposed this request. 4. The short facts of the case are that on 3rd of June, 1993 police had found accused Maluk coming from Pakistan in the Indian territory. He could not produce the passport and hence a case under Rule 3 read with Rule 6 of the Passport (Entry in India) Rules, 1950 was registered. After usual investigation, the police submitted challan. The prosecution examined PW 1 Hanumanaram, PW 2 Bhim Singh, PW 3 Chatar Singh and PW 4 Chhaganlal where witnesses have deposed that the accused was found coming from Pak territory and he was not having passport. The learned trial Court has carefully scuitinised the evidence and has rightly held that the offence against the petitioner is proved, therefore, the conviction of the petitioner is maintained. 5. Keeping in view that the accused had already suffered 28 days imprisonment, I deem it proper to reduce the Sentence. The period already undergone will be sufficient to meet the ends of justice. 6. Consequently, this revision petition is accepted in part and while maintaining the conviction of the petitioner, the sentence is reduced to the period already undergone. The petitioner shall be released forthwith if not required in any other case. A copy of this order be sent to the Jail authorities forthwith.Revision partly accepted. *******
