JUDGMENT 1. - The present writ petition has been filed against the order of the State Government dated 20.9.1995 by which the petitioner was posted as Deputy Registrar Sriganganagar. Initially the petitioner was the Executive Officer CCB, Sikar and he was selected on the post of Secretary PLDB and was posted at Tonk. The grievance of the petitioner is that because of Rajasthan Civil Services (Special Selection and Special conditions of service for selection of Chief Executive/Executive Officers for Apex Cooperative Institutions District Level Banking/Wholesale 'Consumer and Marketing Cooperative Institutions) Rules, 1995, the petitioner should have been allowed to continue till 15.8.1998 or till superannuation as mentioned in the order dated 31.7.195, whichever is earlier. It is submitted that the condition of appointment have been violated and neither the petitioner have been heard nor any opportunity was given and even persons who have been posted in place of the petitioner is not as qualified as the petitioner and he does not fulfill the requisite minimum qualification. 2. The arguments of the learned counsel for the petitioner have been heard at length and two things have been made clear namely; (i) that the posting of the petitioner was as Secretary, PLDB, Jhunjhunu on deputation; and (ii) the lien with the cooperative department is there and even after 1998 or any other anterior or subsequent date unless the petitioner is promoted he was again to be posted as Deputy Registrar in the parented department. This makes it clear that the post of Secretary though is selection post in accordance with the rules as mentioned above, but the posting of the petitioner is only on deputation. The right of the parent department from which the petitioner has gone on deputation always remains to call him back. The power which has been exercised in this case on 20.9.1995 is to call back the petitioner in the parent department and provide him the same post which he was holding in the department. The right of the parent department has been even upheld by the Apex Court that they have always the right to call back the person who has been sent on deputation. 3. In these circumstances, no illegality is found in the order dated 20.9.1995, The petition is accordingly dismissed.Writ petition dismissed. *******
