JUDGMENT : 1. We are in the process of hearing learned counsel on the question whether the waiver by the Cabinet Committee on Accommodation, of huge amounts of money due from various occupants of Government houses was justified or not. It has come to our notice that large amount of money which is due according to the Estate Office record, is also not been recovered by the Department. We direct the Director of Estates to initiate recovery proceedings against all such persons. A notice asking them to deposit the amount within two weeks should be issued, failing which the money should be recovered in accordance with law. We are told by Mr. K.T.S. Tulsi, learned Additional Solicitor General that the money due to the Estate Office can be recovered as arrears of land revenue. A report be placed before this Court on July 9, 1996. 2. Mr. Tulsi states that there may be large number of cases where under the directions of the PMO, houses were allotted to the Government servants. The Director of Estates may indicate approximately the number of cases in such like orders have been received and complied with by the Ministry of urban Development. This may be done within two weeks. 3. Mr. Ranjit Kumar has invited our attention to House No. 6, Lodi Estate occupied by Mr. Syed Mirkasim. Mr. Ramachandran's Report indicates that the Cabinet Committee on Accommodation has allowed the allotment of the said house to Mr. Mirkhasim for life. Mr. Tulsi states that he was not aware that the allotment was made to Mr. Syed Mirkasim for life. He states that he shall look into the matter and file a report in this Court next week.
