JUDGMENT : 1. We are sorry that after these matters were heard for almost 1'/2 days and it was clearly understood that hearing will be completed within the time frame, when these matters were called on for hearing today, some of the learned counsel for the appellants stated that it would not be possible to complete the hearing within the time frame fixed by the Court. Even when yesterday a mention was made as to the allocation of time the Court had pointed out that inter se allocation of time between the counsel representing the same interest should be left to them to arrange between themselves because this Court would not be able to anticipate the extent of participation by counsel for other supporting parties. Even at that time we were not told that it would not be possible to complete the hearing within the outer time frame fixed earlier in point of time before the hearing started. This is all the more unfortunate because senior counsel are appearing in these matters on behalf of the appellants. However, in order that it may not be felt that they did not had an opportunity to put forth their point of view and they may not have any apprehension in regard to miscarriage of justice, we very reluctantly accede to the request but these matters will not receive any priority henceforth. Mr. Setalvad who appears on behalf of the Custodian states that since a lot of time was devoted for 'the preparation of hearing of these cases, the custodian should be duly compensated by costs. The appeals which were taken up for hearing were 10 in numbers, namely, C.A. Nos. 1753,4863- 64, 4390, 5546, 8411 all of 1994 and 3656 57, 3658-59, 6545, 3165 & 3172 all of 1995 and we direct that each of the appellant to pay to the Custodian Rs.25,000/- by way of costs i.e. in all rupees 2 lacs 50 thousand. 2. We also make it clear that merely because these appeals are pending in this Court the enforcement of the order is not stayed and the trials can proceed. 3. Let the matters come up in the normal course and not to be treated as part heard.
