JUDGMENT : 1. We have heard Commandar Sinha in this Interlocutory Application. The main contention of commander Sinha is that it is mandatory to permit a minimum flow in every Inter-State River for echo-preservation and for the purpose of meeting the needs of the people who are residing on the bank of the River. According to Mr. Sinha, even the MOU entered into between various States so far as River Yamuna is concerned, makes provision for this aspect. We are tentatively of the view that while considering these points, it may be necessary to deal with the distribution of the river water among Riparian States which we may not be able to do in view of the Constitutional bar. Commander Sinha, on the other hand, contends that it is not necessary for us to go into that aspect. His contention is that we have simply to direct, if permitted under law, to the Upper Riparian States to permit the minimum flow of water for the preservation of eco-system and other purposes. Commander Sinha further states that Dr. Rajiv Dhawan will assist us on the question of jurisdiction. M. N.N.
