JUDGMENT : 1. Learned Solicitor General informs us of an order made by the Andhra Pradesh High Court in Writ Appeal No. 358/96 on 16.4.96 directing intimation of that case to be given to us for making such direction as we may consider appropriate, in view of certain averments made by the petitioner therein. Having heard learned Solicitor General and Shri A.B. Diwan, learned counsel, we consider it unnecessary to make any order in connection with that case and make it clear that the High Court may deal with that matter in accordance with law. 2. Learned Solicitor General informs us that after the last hearing, charge-sheets have been filed in the Special Court against three more persons, namely, S/Shri Chand Ram, Prakash Bhatia and C.N. Swami, is also submitted that further investigations are in progress in respect of some other persons. 3. Learned Solicitor General also intimated the filing of criminal complaints by the Enforcement Directorate against S/Shri S.K. Jain, J.K. Jain and N.K. Jain about FERA irregularities. He also added that some more criminal complaints of this kind are likely to be filed soon. Learned Solicitor General also mentions the further progress made by the Income Tax authorities which includes the initiation of a criminal prosecution against Shri J.K. Jain for an offence of forgery. 4. Shri A.B. Diwan, learned counsel, filed certain written submissions particularly with reference to investigations against two Governors, namely, S/Shri Moti Lal Vohra and P. Shiv Shankar of U.P. and Kerala respectively. Learned Solicitor General in response submitted that the investigations against both these persons are substantially complete and the only impediment in proceeding further to file the charge-sheets against them is of the immunity they enjoy under Article 361 of the Constitution. Learned Solicitor General wanted some time to put this statement on behalf of C.B.I. in writing in response to the written submissions of Shri A.B. Diwan. Learned Solicitor General states that a comprehensive written response on this aspect to the submission of Shri A.B. Diwan, would be filed by 6.5.96. He is permitted to do so. 5. List the matter on 8.5.96 at 4.00 p.m.
