M. KATJU, J. Heard Counsel for the petitioner and learned Standing Counsel for the State. 2. In the impugned order dated 14-11-94 it is mentioned that twenty-one other licencees are in the village and hence an arms licence cannot be given to the petitioner. I have held in Writ Petition No. 25961 of 1994 dated 8-12-94, Girdhar Gopal Pandey v. The Commissioner Al lahabad & Ors. , that this is not a valid ground for rejecting an application for arm licence. 3. Hence, I set aside the impugned order dated 14-11-94 and the order dated 11-11-92 and direct the District Magistrate, Allahabad, to pass a fresh order in accordance with law on the petitioners application for arm licence within two months on the production of the certified copy of this order before him. 4. The writ petition allowed. No order as to costs. Petition allowed. .
