ORDER : N.P. Singh, J. 1. Leave granted. 2. The appellant was on deputation to the Central Water Commission. After the period of deputation was over, the appellant was reverted to his parent department. The appellant did not join the parent department. No payment of salary for the period from 6-11-1989 to 12-12-1990 was made. The petition filed before the Tribunal was dismissed. This Court on 2-11-1995 asked the counsel for the respondents to seek instructions whether the Department would be willing to treat the period aforesaid for continuation of the appellant's service. The respondents have left the question to the Court. 3. Taking all the facts and circumstances into consideration, we direct that the appellant should not be paid any salary for the aforesaid period but that period may be counted towards his service in the parent department and should be adjusted towards leave available to the appellant. 4. Appeal is allowed in part. No costs. Appeal allowed in part.
