JUDGMENT : 1. Special leave granted. 2. The date of birth of the respondent was entered in the Service Register as 1.7.1937 on the basis of the School Leaving Certificate produced by the respondent himself. The said date of birth is sought to be changed to 1.7.1940 on the strength of a horoscope and the factum of he being the eight child of his parents. We do not think that the evidence produced in the form of the, horoscope was strong enough to rebut to evidence of the date of birth in the School Leaving Certificate. We also do not think that the evidence is regard to he being the eighth child was also sufficient to unsettle the date of birth in the School Register. We are, therefore, of the opinion that the Tribunal ought not to have interfered with the date' of birth recorded in the Service Register. The appeal is, therefore, allowed. The order of the Tribunal is set aside. There will, however, be no order as to costs.
