ORDER 1. Mr P.M. Nayar, DIG of Police who is investigating Khalra case on half of the CBI is present in the Court. A short Report running into 8 pages ted 15-7-1996 and signed by Mr J.K. Dutt has been filed in the Court. Mr ayar states that the investigation is almost complete. According to him, the action to be taken in the light of the investigation has also been planned. He states that It .would be possible for the CBI to place before this Court the report regarding Khalra within a weeks time. He may do so. We adjourn the hearing of this case to 30-7-1996. We give liberty to Mr Nayar to file the Report file the Court. WP No. 447 of 1995 2. While directing investigation by the CBI vide our order dated 15-11-1995, we also took notice of the second issue highlighted in the petition. The said Issue related to the disposal of dead bodies of a large number of persons -allegedly, thousands with a label "unidentified". We directed the CBI to investigate the matter and report to this Court. Mr S.P.S. Dutt, Dy. Superintendent of Police, CBI who is investigating this matter is present in the Court. The CBI has placed on record its Report which runs into 74 pages. According to Mr Dutt, the investigation is in progress. On the basis of the material collected in the enquiry by the CBI, it has, prima facie, been found C that a total of 984 dead bodies were cremated as "lavaris" by the police in the Police District of Tarn Taran. It is further stated that the detailed scrutiny would be made in the coming days. In the last para of the Report, it has been stated that this Court may consider ordering registration of three separate criminal cases in respect of the death in suspicious circumstances of Bhagal Singh alias Gurdarshan Singh, Pyara Singh and Pargat Singh Bullet. It is d stated that so far as the death of these three• persons is concerned, there is enough material with the CBI to register criminal cases and further investigate the cause of death after registering the cases. We direct the CBI to immediately register three separate cases in respect of Bhagal Singh alias Gurdarshan Singh, Pyara Singh and Pargat Singh Bullet. 3. As stated above, the enquiry by the CBI is continuing.

Since a large e number of dead bodies have been allegedly disposed of by the police, it may be necessary to seek assistance from the public at large. We direct the CBI in the course of enquiry to issue a general direction to the public at large that if any person/authority/government office has any information/material which may be of any assistance to the CBI in the enquiry in this matter, the same f shall be placed before the CBI. We direct Mr P.S. Sandhu, DIG (Border) to hand over the entire relevant record to the CBI immediately. Any delay in this matter shall be taken to be violation of this Courts order which will attract the provisions of the Contempt of Courts Act, 1971. Mr M.L. Sarin, Advocate General, Punjab is present in court. We request Mr Sarin to personally see that all assistance in this matter is rendered to the CBI. 4.
