JUDGMENT : 1. The learned ASG has drawn our attention to the latest affidavit filed in the matter of constitution of the autonomous body and has stated that the matter is to be further thrashed out before a final decision is taken and placed before this Court. Mr. Salve the learned counsel for the Sole Trustee states that the Committee should be really autonomous in both letter and spirit and Ms. Jaising also points out, and we think rightly that there should be some public participation in the sense of representatives of the beneficiaries for whom the hospital is set up so that the problems of the victim group could be brought before the autonomous body from time to time to enable the autonomous body to resolve their problems also as and when they crop up. We think that the basic idea of having an autonomous body is not to load it with public servants but have a fine mix of both experts, Government participation as well as public participation so that the initial idea of the Court in stating that there should be an autonomous body to run the hospital may be satisfied. We do not propose to hedge the decision but have only indicated broadly what would be an ideal autonomous Committee and would leave it to the decision making body for the present to come up with a final decision in the subject. 2. Let the matter come up after 8 weeks.
