JUDGMENT 1. - The defendant petitioner submitted an application before the lower Court for having disputed thumb impression of his father on the agreement compared with the thumb impressions on the khatas executed in the accounts book of Bal Chand Sunar by a finger print expert has been rejected by the impugned order. This order has been assailed in this revision petition. 2. The plaintiff non-petitioner instituted a suit for specific performance of the agreement dated 13.8.1969 said to have been executed by the defendant petitioner's father late Shri Mangya agreeing to sell his half share in agricultural land bearing khasra No. 1009 measuring 3 bighas and 2 biswas and khasra No. 1012 measuring 9 bighas and 4 biswas for Rs. 35,001/- in favour of the non-petitioner's husband late Shri Hasan Khan. If the said agreement is forged document, the defendant petitioner can take recourse of the proceedings under section 195 Cr.P.C. by moving an application before the Court below with regard to alleged forged document. At the time of adjudication of the application for issuance of temporary injunction no such comparison as alleged in the application is necessary. The Court below has not committed any illegality in exercise of jurisdiction vested in it in dismissing the application. Consequently the revision petition is dis- missed. No costs.Revision allowed. *******
