JUDGMENT : S.P. Bharucha, Faizan Uddin and S.B. Majmudar, JJ. 1. This is an original suit between the State of Orissa and the State of Andhra Pradesh. By an order dated 27th February, 1992, the suit was adjourned to enable the parties to file applications with respect to the examination of witnesses and the exhibiting of documents. Pursuant to the order, the State of Orissa has filed an application dated 29th April, 1993, exhibiting as an annexure the names of its witnesses. The application pray that the District Judge, Koraput, Orissa, be appointed Commissioner to examine the witnesses. It is stated that the District Judge, Koraput, Orissa is closest to the villages concerned in this suit. The State of Andhra Pradesh has also filed an application, which is dated 20th April, 1982. It seeks the examination of two witnesses, who are mentioned. It also seeks a direction that such documents as have been filed by the State of Andhra Pradesh and been admitted by the State of Orissa be marked as exhibits. 2. The District Judge, Koraput, Orissa is appointed Commissioner to examine the witnesses mentioned in the application of the State of Orissa and the two witnesses mentioned in the application of the State of Andhra Pradesh. The Commissioner shall mark as exhibits in the original suit documents that are produced by one party and admitted by the other. The Commissioner shall be at liberty to examine such other witnesses as the parties may want to examine, after notice to the other parties. After the recording of evidence and the marking of exhibits as aforesaid, the Commissioner shall forward the transcript of the evidence and other proceedings before him to the Registrar General to this Court. 3. The parties shall produce copies of the pleadings proceedings and orders in the original suit before the Commissioner to enable him to proceed. The parties shall appear before the said District Judge on 4th September, 1995, on which date the Commissioner shall give directions as to further proceedings.
