JUDGMENT : 1. The Superintendent Jail, Amritsar to file an affidavit in this Court within 2 weeks indicating as to whether Kulwant Singh, convict under NDPS case, has filed an appeal or not. He shall also indicate as to what assistance was rendered to him. Since the conviction of Kulwant Singh has become relevant in view of CBI report in Khalra case, we direct the Supdt. Jail to file an appeal on behalf of Kulwant Singh before an appropriate court. 2. The order be communicated to the Supdt. Jail Amritsar telegraphically by 9.8.96 and also be sent by ordinary post. 3. Mr. Jaswant Singh Khalra, General Secretary, Human Rights Wing of Shiromani Akali Dal was allegedly taken away by the police from near about his house on August 6, 1995. This Court took notice of the telegram received from Mr. gurcharan Singh Tohra and issued notice to the parties concerned. On November 15, 1995 this Court passed the following order: "Mr. M.L. Sareen, learned Advocate-General, Punjab has very fairly stated that keeping in view the serious allegations levelled by the petitioner against the officers/officials of the Punjab Police, it would be in the interest of justice that the investigation in this matter be handed over to an independent authority. Even otherwise, in order to instill confidence in the public mind and to do justice to the petitioner and his family it would be proper to withdraw the investigation from Punjab Police in this case. We, therefore, direct the Director, Central Bureau of Investigation to appoint an investigating team headed by a responsible officer to hold investigation in the kidnapping and whereabouts of Khalra. We further direct the Director General of Police, Punjab, all concerned Punjab Police Officers, Home Secretary and Chief Secretary Punjab to render all assistance and help to the CBI in the investigation." 4. Ajit Singh Sandhu, SSP, Police District Taran Taran; Ashok Kumar, DSP, Bhikiwind, Police District Taran Taran; Jaspal Singh, DSP, Taran Taran; Satnam Singh, SI/SHO P.S. Chabal; Surinder Pal Singh, SI/SHO P.S. Sirhali; Jasbir Singh, SI/ SHO P.S. Manochahal; Rashpal Singh, SI/SHO P.S. Kang; Amarjit Singh, ASI P.S. Chabal and Pritpal Singh, HC P.S. Manochahal, for the offences punishable under section 12-B r/w 365 and 220, IPC. S.Shri Ashok Kumar, DSP, Satnam Singh, SI, Surinder Pal Singh, SI, Jasbir Singh, SI, and Pritpal Singh, HC, are also to be prosecuted for the substantive offences punishable under section 365, IPC. Some of the officers are further to be prosecuted under Section 22 IPC. The CBI has moved the Punjab Govt. for grant of sanction under Section 197 Cr.P.C. This Court by the order dated July 30, 1996 has directed the Chief Secretary/Home Secretary Punjab to decide the question of sanction pending before it within three weeks. We deferred the question of interim compensation to the family of Mr. Khalra, for the next hearing. 5. The CBI is continuing further investigation regarding the whereabouts of Mr. Khalra. The fact remains that the abductors are keeping Khalra away from his family since August 6, 1995. Mr. Paramjit Kaur, wife of Mr. Khalra has approached almost all the authorities and has been running from pillar to post. Needless to say that the wife of Mr. Khalra and his family are in great agony. Kidnapping of a person whose family is totally in dark about his where about - even about the fact whether he is alive or dead - is the worst crime against humanity. In the facts and circumstances of this case, we direct the Punjab Govt. through the Chief Secretary, Punjab to pay a sum of Rs. 10 lacs (Rupees ten lacs only) as interim compensation to Mrs. Paramjit Kaur, wife of Mr. Jaswant Singh Khalra. In case the police officers are convicted the State of Punjab can recover the amount from the police officers. The amount shall be paid to Mrs. Paramjit Kaur within two months from today by way of a demand draft in her name. 6.
