JUDGMENT : 1. Leave granted. 2. We have heard learned counsel for the parties. 3. In the view that we propose to take, it is not necessary to advert to the history of the litigation leading to the filing of SLP (C) No. 24947 of 1995. On 2.11.1995 the following order was made by this Court. "Issue notice to the respondents limited to the question to show cause why the dispute arising out of defective meter, as alleged by the petitioner, be not referred to the arbitration of the Electrical Inspector under Section 26 read with Section 52 of the Indian Electricity Act, 1910". In our opinion, it is a fit case in which the disputes and differences which have arisen between the appellant and the Madhya Pradesh Electricity Board, with which it had entered into an agreement for supply of high tension electricity, touching upon the allegedly defective meter and its effect be referred for decision to the Electrical Inspector in terms of Section 26(b) of the Indian Electricity Act, 1910. We make an order accordingly. The Electrical Inspector shall decide the matter, after hearing the parties in accordance with law. No costs.
