JUDGMENT : 1. (A) We have been taken through the affidavit filed by Under Secretary, Ministry of Urban Development, Government of U.P. regarding the setting up of S.T.Ps in Ghaziabad, NOIDA and other towns in the National Capital Region. Mr. Ranjit Kumar states that he would frame the issues which are involved in relation to these towns. He may do so within one week. 2. To come up on 6th September, 1996. 3. (B) Pursuant to this Court's order dated 7th August, 1996 the Central Pollution Control Board has placed on record its report regarding the two industries namely M/s. Haryana Organica, Samlkha, Panipat and M/ s. East India Cotton Manufacturing Co. Ltd., Faridabad. According to the report the B.O.D. level regarding the effluent discharged by M/ s. Haryana Organics is 43 mg/1. Although under the Rules the normal level is 100 mg/ 1. But the standard stipulated by the State Board is 30 mg/1. We agree with the contention of Mr. Panjwani that the standards prescribed by the Haryana Pollution Control Board have to be complied with. Since the B.O.D. level regarding this Industry is marginally high, we give opportunity to the Industry to improve its standard. The Industry has promised that it shall also install aerator. We direct the C.P.C.B. to inspect the Industry after six weeks. Although the analysis of the samples shall be done by the C.P.C.B., the Haryana Board may be associated by the C.P.C.B. Our order dated 7th August, 1996 shall continue till further orders. 4. Regarding M/s. East India Cotton Manufacturing Co. Ltd., the B.O.D. level is 110 mg/1. We see no justification to continue our order in respect of this Industry. We modify the order to the extent that so far as the stay granted by the Civil Court is concerned, that shall continue to be stayed. We, however, vacate the stay orders so far as the Haryana Pollution Control Board is concerned. The Board shall proceed in accordance with law.
