JUDGMENT : Item `A' of the Office Report dated 11-9-1996 1. Pursuant to this Court's order dated April 10, 1996 and subsequent order dated May 10, 1996, Mr. P.C. Gupta, General Manager, Gas Authority of India has filed an affidavit. It is stated in the affidavit that necessary directions in the pipe-line design corrosion protection, protection during construction and during operations have been. taken by the Gas Authority of India. It is for the Central Pollution Control Board or the State Pollution Control Board concerned to examine the legal position and do the needful, if anything is to be done under law. Mr. Gupta, in para 5, has further stated as under: "However, in its endeavour GAIL has not received sufficient response from the industrialists in the City of Agra, where prospective industrial consumers of gas have not yet worked out how to convert the cupola furnaces to gas fired ones. Hence, GAIL apprehends that after it has undertaken provisioning such an expensive infrastructure exercise, it may not have enough consumers for the gas supplies in Agra at least during the near future of commencement of the supply. This Hon'ble Court may therefore, direct the prospective consumers to inform this Hon'ble Court of their willingness to convert to gas." 2. Mr. Sibal and Mr. Parekh, learned counsel appearing for most of the industries have informed us that the industries are taking steps to approach the GAIL for gas connection. Mr. Parekh further states that most of them have already done it. This is a matter between the industries and GAIL. It is for their benefits that the industries should approach the GAIL for gas connections. Item 'B' 3. Mr. Satish Chandra, learned counsel appearing for Agra Development Authorities has very fairly stated that a building where the Corporations and the photographers are proposed to be shifted has been located. He further states that the building is 200 yds. away from the boundary of the Taj. He states that partition etc. in the building is to be done and some other formalities are to be completed. He states that he would be in a position to make a positive statement in this respect after two weeks. 4. List the matter on 3rd October, 1996.
