D. P. Bhattarcharya v. West Bengal Pollution Control BD.

1996-09-27

KULDIP SINGH, S.SAGHIR AHMAD

body1996
JUDGMENT : 1. We requested the Advocate General to suggest how and in what manner the land which would become available by shifting/closure of the industry, dealt with by this Court in Dr. D.P. Bhattacharya's Case, would be utilised. We are told that the Advocate General is out of the country and as such he is not in a position to be before us today. Be that as it may, we are of the view that the land ultimately vacated by the said industries may be utilised in the same manner as we directed in our order dated May 10, 1996 in I.A. No. 22 in Writ Petition (C) No. 4677/85 (M.C. Mehta v. Union of India & Ors.). Mr. Dilip Sinha appearing for the Government states that he would communicate this order to the Government and shall have the Government's response on October 29, 1996. 2. To come up on October 29, 1996.
