JUDGMENT : 1. The Embassy of Israel through its counsel Mr. Ravinder Nath has communicated today that it is not possible for it or for the Government of Israel to purchase the said property at the price mentioned by M/s Price Water House & Co., Chartered Accountants, New Delhi. In the circumstances, we have no option except to sell the said property by public auction. Accordingly, tenders shall be called for from public. 2. The D.D.A. shall ensure that a notification is published in two newspapers 'The Times of India' and 'The Statesman' in all editions, with respect to the sale of the said property. The publication shall be effected on or before 25.10.96 and the last date for submitting the tenders is 22.11.96. The notification shall mention that the minimum price shall be Rs. 28 crores. No tender quoting a lesser figure shall be considered or accepted. The notification shall further state that the building is now occupied by Israel Embassy as a tenant. 3. The tenders shall be submitted to Mr. Chandresh Bhushan, Registrar General of the Supreme Court of India in sealed covers. The tenders shall be accompanied by a demand draft for a sum of Rs. 1 crore drawn on any Nationalised Bank in India. Any tender which is not accompanied by the demand draft shall be rejected. The demand draft shall be a crossed demand draft drawn in favour of the Registrar General, Supreme Court of India. It is obvious that in case of tenders being not accepted the amount shall be returned to the tenderers. 4. Any prospective tenderer who wants to inspect the property shall approach the Registrar General. The Registrar General shall get in touch with Mr. Ravinder Nath, counsel for the Embassy of Israel and fix up two dates on which the Israel Embassy shall permit the prospective tenderers to have a look at the public areas of the property. 5. The D.D.A. shall make available the copies of plans of the property and also all relevant papers executed in favour of the Israel Embassy to the Registrar General, Supreme Court of India which shall be open to inspection by the proposed tenderers. 6. List these matters in the first week of December, 1996., 7. Letters/claims/applications received from creditors with regard to their claims against Skipper Construction Company be sent to Hon'ble Mr. Justice O. Chinnappa Reddy for consideration.
