JUDGMENT : Item A Mahila Ashram and Arya Gurukul 1. We have heard learned counsel appearing for Mahila Ashram and Arya Gurukul. The area suggested by Sibal Committee and also by Mr. Khanduri can easily be separated and taken away from the main area. We, therefore, direct that the approach road which covers an area of 650 sq. yds. adjoining, the Ashram should be closed and the area be added to the Ridge. This may be done within two months. Item B Sacha Ashram Sauda Gurdwara 2. Mr. Balbir Singh, the occupant of the Gurdwara is present before us. He states that he can shift Guru Granth Sahib to the main Gurdwara which is about 150 yds. away from this encroached land immediately. He further states that he is also using the place for his residence. He needs reasonable time to vacate the place. According to him, his two children have to appear in the examinations in the month of March and he should be given time upto the end of March. We agree with him. We direct that he should immediately shift Guru Granth Sahib to the adjoining Gurdwara and he himself shall vacate the premises and hand over vacant land to the Ridge Management Board on April 2, 1997. We direct the Ridge Management Board through Mr. Khanduri to take over the possession on April 2, 1997 and do the necessary fencing and aforestation on the area. Item C Ram Tirath Temple and another Temple (Vaishno Devi Temple) at Rajinder Nagar 3. Learned counsel appearing for the Ram Tirath Temple and the other temple states that construction has not been done because litigation is pending in the courts. According to Khanduri report, the so called temple is without any roof and the adjoining temple has only asbestos sheets and there are no walls. We direct the Ridge Management Board through Mr. Khanduri to take over possession of the premises from the management of the temples. Learned counsel for the temple wants two months time. We give three months time to the learned counsel to vacate the premises. He shall do so before January 31, 1997. Item D Baba Asa Ramji 4. Mr. R.S. Suri, learned counsel states that he would have another round of discussion with Mr. Khanduri and Mr. Ranjit Kumar to ascertain as to how much area is to be left with the Management.

We make it clear that the approach roads etc. which are being used by the temple shall have to be closed permanently. This matter may also be taken into consideration while holding the discussions. This may be done within one week. We further make it clear that no vehicle shall be permitted to enter the Ridge area. 5. Ridge matter to be listed on 8.1 1.1996. I.A. No. 22 Item E of the Office Report 6. Pursuant to this Court's order dated October 24, 1996, Sh. Ganga Das, (IAS), Principal Secretary and Commissioner (Industries), Govt. of NCT of Delhi has filed an affidavit dated October 30, 1996. In Para 3 of the affidavit it is stated that 102 acres of land is already available as per detail given in the said para with the Government of Delhi. This 102 acres of land is available in Narela Indl. Estate, Jhilmil Indl. Area, Badli Indl. Estate, Okhla Indl. Estate, Jhilmil Tahirpur, and Patparganj Industrial Estate. This land is already developed and can be utilised for construction of flatted factories immediately. Mr. Swaraj Kaushal, learned counsel for the NCT, Delhi Admn. states that near about 5000 industries can be accommodated in 102 acres already available with the Government of Delhi. We direct the Delhi Administration to invite applications confined to the industries which are to be relocated for allotment of flats/plots in the above mentioned 102 acres. It is entirely for the Delhi Administration to lay down the policy and the scheme regarding inviting applications and allotment of flats to the intending purchaser. The advertisement inviting applications shall be issued by the Government within one month from today. 7. Para 5 of the affidavit further states that 4800 acres of land is available in villages mentioned at SI. No. I to 7 in the said paragraph; 1. Alipur, Kherakhurd, Naya Bans, Khera Kalan, Jindpur. 2. Holambi Khurd, Holaumbi Kalan, Khera Khurd, Naya Bans. 3. Bawana 4. Kanjawala, Sultanpur Majra 5. Kanjawala and Chandpur 6. Tikri Kalan 7. Tikri Kalan 8. Mr.

Mr. Omesh Saighal, Member Secretary, National Capital Region Planning Board states that 4800 acres is a very large area and in fact may not be required for the development of the industrial estates. He further states that the areas which are not within the proposed urban extension limits may not be permitted to be used as at present for industrial purposes. We shall consider this suggestion at a later stage. As at present we only direct that the acquisition proceedings in respect of the three villages at S1. Nos. 1, 2 and 3 in para 5 of the affidavit (mentioned above) may be initiated with immediate effect. The necessary notification etc. may be issued and possession taken within one month from today. 9. We-further direct that the NCT, Delhi Admn. shall issue a public notice in three daily newspapers (English and Vernacular) on three consecutive days asking the industrial operating in residential/non- conforming area to apply for allotment of plots to the authority mentioned in the advertisement. It shall further be stated in the advertisement that the industries shall also be required to give undertaking that on allotment of the plot they shall shift from the present place to the industrial estate where the plot/flat is allotted. The allotment procedure regarding the land to be acquired may also be devised by the NCT, Delhi Admn. in similar manner as it is going to devise for 102 acres of land. We made it clear that plots/flats shall only be offered to the industries which are to be relocated from the residential/non-conforming areas of Delhi and not to the new units. Meanwhile, the NCR Board may give its response to the scheme proposed by the Delhi Admn. 10. To come up on 28.11.1996. I.A. No. 32 Item F 11. Adjourn to 21.11.96 to enable Mr. Mehta and Mr. Ranjit Kumar to study the NEERI Report and the affidavit filed by the Ministry of Water Resources and assist this Court. 12. Matter regarding H(a) and H(b) categories (822 industries which are subject matter of order dated 6.9.96) shall be listed on 19.11.1996.
