ORDER 1.Leave granted. 2. Heard learned counsel for the parties. This appeal is directed against e judgment and order of the Delhi High Court dated 24-5-1996 passed in A No. 82 of 1996. Considering the facts and circumstances of the case and so considering the submissions made by the respective counsel for the arties, we are of the view that reasons for cancellation of the previous contract of the appellants as communicated to them do not stand scrutiny. e pass the following orders which, in our view, will meet the ends of justice in the facts of the case: 1. In the facts of the case, we feel that the serial Chandrakanta should be telecast on Doordarshan 1; 2. We are told that Doordarshan 1 is telecasting in 9.30 p.m.-10.30 p.m. on Monday evening slot Alif Laila and Ajnabi. The learned Solicitor General submits before us that the aforesaid two serials are shortly going off the air with effect from 30-12-1996 and 6-1-1997 respectively and further that Doordarshan has entered into an agreement for the telecast of serial "Om Namah Shivay" which is said to have a contractual run of 91 episodes starting with effect from 6-1-1997; 3. It is directed that after the telecast of 91 episodes of Om Namah Shivay or the last telecast of any episode of Om Namah Shivay earlier than the said 91 episodes, the serial Chandrakanta produced by the appellant shall be telecast from the succeeding week on the same slot, i.e., 9.30 p.m.-10.30 p.m. on Monday evening slot on Doordarshan 1 on the following terms and conditions: (i) The serial Chandrakanta will telecast four episodes which would be primarily for the purpose of recapitulating the earlier 92 episodes already telecast by Doordarshan. These four episodes shall precede the balance 58 episodes. After telecasting the said four episodes, the serial Chandrakanta will be telecast in 58 episodes; (ii) The appellants undertake before this Court that the appellants will not telecast each of the said 58 episodes on any other channel prior to the telecast of each of the said 58 episodes on Doordarshan 1; (iii) The appellants shall furnish a minimum guarantee of Rupees 40.50 lakhs (gross). The appellants will get the same FCT (free commercial time) which is made available to Om Namah Shivay, namely 720 seconds.

It is made clear that the aforesaid minimum guarantee will apply to the 58 episodes of Chandrakanta which will be telecast, but with regard to telecast of four episodes way of recapitulation, the minimum guarantee will be Rs 25 (gross). The appellants will be given 490 seconds of FCT (free commercial time) for such four episodes; (iv) The appellants shall submit the synopsis of the episodes be telecast to Doordarshan in respect of fresh 58 episodes six months in advance before the telecast; (v) It will be open to the appellants and Respondents 1 to, alter the above terms and conditions by mutual consent. Li given to the parties to approach this Court in the event of there any difference between the said parties in arriving at arrangement by mutual consent; (vi) Doordarshan shall issue an allotment letter to the appellants in terms of this order within two weeks from today. The appellants and Respondents 1 to 3 thereafter will enter into a formal contract is done in other cases; (vii) It is further directed that Doordarshan will comply these directions notwithstanding any other direction given to any other court. 3. In the facts and circumstances of the case, the parties will bear own costs. The appeal is accordingly disposed of.
