JUDGMENT : 1. Pursuant to this Court's order dated December 17, 1996 Mr. P.K. Mohanty, Director, Department of Urban Development, Government of India and Mr. R.C. Aggarwal, Director, Archaeological Survey of India are present in Court. According to Mr. P.K Mohanty, it is for the Human Resource Development Department, Department o Culture, Government of India to consider the question of declaring Agra as a "World Heritage City". Mr. Aggarwal on the other hand, states that Department of Culture can only declare a Monument as World Heritage and not a city. According to him, it is for the Ministry of Urban Development to declare the City as a" World Heritage City" We do not wish to comment on the inner functioning of the Government Departments. The learned counsel for the Government of India has placed before us a letter dated May 3, 1995 addressed by Dr. S.K. Mahapatra, Secretary, Department of Culture, Ministry of Human Resource Development, Government of India, New Delhi to Mr. J.M. Lyngdo, Secretary, Department of Tourism, New Delhi, wherein it is stated that the Department is already examining the proposal to declare Agra as a "World Heritage City". It is, thus, obvious that the Department of Culture is seized of the matter and a decision has to be taken by the said Department. Be that as it may, it is for the Government of India to consider and finalise this matter. We direct the Secretary, Ministry of Human Resource Department, Department of Culture, Government of India, and also Secretary, Urban Development Department, Government of India, to take a decision on the proposal to declare Agra as "World Heritage City", within two months of the receipt of this order. If it is necessary to consult the State Government for this purpose, that may also be done. 2. Copy of this order be sent to the two Secretaries within 30 days from today.
