Judgment B.P.Singh, J. 1. Heard counsel for the parties. 2. The petitioners have challengned confiscation proceeding No. 5 of 1995-96 under Section 6-A of the Essential Commodities Act initiated against them, which is pending before the Deputy Commissioner, Singhbhum West at Chaibasa. 3. The allegation against the petitioners is that 104 bags of wheat were unloaded in clandestine manner and it is suspected that the aforesaid bags of wheat bearing mark of F. C. 1. were stolen property. 4. Counsel for the petitioners submits that so far as wheat is concerned, it does not come within the purview of commodities for which licence has to be taken under the Unification Order. It is submitted that the Government has taken a decision Annexure-7 removing wheat from the schedule to the Unification Order, which has been taken pursuant to Annexure-5 the policy decision of the Central Government and therefore, a trader 16 not required to take out a licence for trading in wheat. 5. This legal position is not disputed by the counsel appearing for the State. If it is so then there can be no proceeding under Section 6-A of the Essential Commodities Act in rgard to any transaction concerning a licence under the Unification Order. 6. In these circumstances, the confiscation proceeding being Confiscation Case No. 5 of 1995-96 pending before the Deputy Commissioner, Singh bhum West at Chaibasa is hereby quashed. This, however, will have no affect on the criminal case, which has been filed against the petitioners under the provisions of the Indian Penal Code. 7. This application is disposed of accordingly.
