Judgment D. P. Wadhwa, S. J. Mukhopadhya, J. 1. Supplementary counter-affidavit has been filed today which has been sworn by Mr. Vijoy Kumar Sinha, deputy Secretary, Home (Police)Department. Mr. Sinha, learned counsel for the State submits that wireless message has been sent to all the District magistrates to supply certain informations vide Annexurc-R-1/8 of the affidavit. In our view, such type of communication is nothing but a stand to delay the matter and provide an excuse. 2. It is stated that there are 562 posts of A. P. Ps and only 434 are working and step will be taken to fill up the remaining vacancy as there is persistent complaint from the Judicial Magistrates that their working has been held up due to lack of A. P. Ps in their courts. In this view of the matter State is directed to provide 562 A. P. PS for the Judgeships of the State depending upon the number of courts of Judicial Magistrates. Information regarding the number of Judicial magistrates shall be furnished to Mr. Sinha by the Registrar-General of this court within one week. 3. We shall be informed on the next date of hearing as to what steps are to be undertaken by the State to provide official space and library facilities to the a. P. Ps in various Judgeships/sub-Divisions of the State of Bihar. The list of books required for the library meant for A. P. Ps in every Judgeships/sub-divisions of the State shall be given by the Registrar of this Court to Mr. Sinha learned Counsel for the State. 4. It is contended by the learned counsel for the petitioners that the original quarters meant for the A. P. Ps have been occupied by certain police officers. Mr. Sinha has drawn our attention to Annexure-R-1/c filed with the supplementary counter-affidavit that these quarters have been ordered to be vacated within two weeks from 9.5.1996. 5. As regards extra quarters for residence of the A. P. Ps Mr. Sinha, learned Counsel for the State contends that he will take necessary steps. 6. Mr. Sinha says that instruction has been given to the Collector of every district of the State to provide one clerk-cum-steno/typist for the use of the a. P. Ps and one peon for every judgeship/sub-division. Steps be taken to provide faras/sweeper for the AP. Ps in every Judgeship/sub-division. 7. It is not disputed that the AP.
6. Mr. Sinha says that instruction has been given to the Collector of every district of the State to provide one clerk-cum-steno/typist for the use of the a. P. Ps and one peon for every judgeship/sub-division. Steps be taken to provide faras/sweeper for the AP. Ps in every Judgeship/sub-division. 7. It is not disputed that the AP. Ps will appear in Court in prescribed dress which consists of black coat, tie, white shirt and white stripes trousers. That dress has to be provided by the State government and also necessary allowances for washing etc. of the dress for which the petitioner shall file proper affidavit giving cost of the materials to be charged and the maintenance allowances. 8. As regards the medical facilities and leave travelling concession and other facilities, Mr. Sinha says that the same will be provided to them likewise other Government employees. 9. We also see no reason in not providing at least one telephone connection for the use of the AP. Ps in every judgeship/sub-division for easy facility to send information to the police- station and other officials concerning the cases. 10. It is considered if all the facilities are provided to the AP. Ps. we expect that they will perform their duty properly in Court time and conduct the cases with all earnest. This Court will also ask for report from every Judgeship whether the AP. Ps are performing their duties properly. 11. Let this matter be listed on 1st july, 1996 under the same heading within first ten cases. Copies of this order be handed over to the learned counsel for the parties as well as the registrar-General of this Court. Order Accordingly.
