JUDGMENT 1. - The petitioner has filed this petition under Section 482 Criminal Procedure Code against the order of learned Addl. District Judge, Nimbaheda dated 16.9.95 by which the learned Addl. District Judge partly allowed the revision petition filed by the petitioner and ordered for delivery of the vehicle but imposed certain conditions. 2. Learned counsel for the petitioner has only made grievance regarding the condition by which learned Addl. District Judge has ordered the petitioner to deposit road tax before taking delivery of the vehicle on the conditions imposed by learned Magistrate. 3. The petitioner cannot avoid due tax and if a demand is raised, he will deposit the tax but it will not be necessary for him to deposit the tax prior to taking delivery of the vehicle. 4. This petition is only allowed with this modification, other conditions will remain the same as ordered by the learned Addl. District Judge. 5. The petition stands disposed of in terms of aforesaid direction.Petition Disposed of. *******
