JUDGMENT : 1. Pursuant to this Court's order dated February 14, 1996 Mr. Ashok Kapur, Labour Commissioner, Govt. of NCT Delhi has filed an affidavit. According to him, two Electroplating units, namely, M/ s. Radha Krishna Industries, WZ-665A, Tihar Village, New Delhi-110018 and M/ s. Anmol, WZ-316, Kachcha Tihar, New Delhi were found employing a child labour each. It is further stated that proceedings under the Child Labour (Prohibition and Regulation) Act, 1986 are being initiated against the occupier/proprietor of these two units. 2. Mr. Sanjay Singh, Additional Deputy Commissioner of Police, West Distt., New Delhi has sent a letter dated February 29, 1996 addressed to the Assistant Registrar (PIL Cell), Supreme Court of India. Along with the letter he has sent its report of the action taken pursuant to this Court's order dated February 14, 1996. He has given a list of five industries where child labour (under 18 years) was found to have been employed. The names of the industries are as under: 1. M/s. Hind Platers, 9/2 Subash Nagar. 2. M/s. Omega Speakers, 10/74, Subash Nagar. 3. M/s. Pooja Electroplating Works 12/60, Subash Nagar. 4. M/s. R S Grover Shop No. 8, Block No. 7 Subash Nagar. 5. M/s. Darshan Lal, Shop No. 1, Main Market Subash Nagar. 3. We issue notice to the above mentioned 7 industries returnable on March 29, 1996 to show cause why proceedings in accordance with law including compensating the minors be not initiated against them. List the matter on March 29, 1996. Item B of the Officer Report. 4. Shri D.S. Negi, Development Commissioner/Secretary, Environment, Chairman, Delhi Pollution Control Committee and Shri Ponnada Venkatarao, Deputy General Manager (Legal), IDBI have filed their affidavits. Mr. Kaushal has brought to our notice the scheme under which the construction of the common effluent treatment plants for cluster of Industries in he city of Delhi are to be financed. According to him 25% is to be contributed by the Union of India and 25% by the State Government subject to the ceiling of Rs. one crore in respect of both these contributions. The remaining 50% is to be contributed by the IDBI and the Industries concerned (30% by IDBI and 20% by Industries). 5. The IDBI in its affidavit has indicated very cumbersome and lengthy procedure for sanctioning the necessary financial assistance.

One of the conditions is that a group of Industry must form a Company for the purposes of undertaking the construction. 6. We are prima facie of the view that the ceiling of Rs. one crore fixed in so far as the total contribution of the two States is concerned is unreasonable, keeping in view the present cost of construction of the common effluent treatment plants. We are further of this view that the procedure prescribed by the IDBI is also unreasonable and has to be simplified. We are tentatively of the view that the work of construction of the common effluent treatment plants in respect of 28 Industries/Estates in the city of Delhi may be entrusted to the Delhi Water Supply and Sewage Disposal Undertaking. The Undertaking is already in the process of constructing 13 Sewage Treatment Plants in the city of Delhi. Before we pass final directions in this respect, we would like to have the response of the Government of India, the State Government and IDBI and the Undertaking. We direct all these four authorities to deputy a responsible officer with full knowledge and study on the above-mentioned subject.
