Judgment D. P. Wadhawa, S. J. Mukhopadhaya, J. 1. This Letter Patent Appeal has been listed today itself on mentioning made by Mr. Ram Balak mahto, learned Counsel for the Appellant. It is in view of the fact that by the impugned order dated 12-9-96 the learned Single Judge has directed for handing over the possession of the site in question by 14-9-96. 2. This Appeal is directed against the judgment and order of the learned single Judge passed on 12-9-96 allowing the writ application of the 2nd respondent. 3. Mr. Surendra Kumar Singh, learned Counsel appearing on behalf of the appellant gives the following undertaking on behalf of the appellant, as per separate sheet attached with this order. He placed on record a letter dated 13-9-96 of the Principal, Patna womens College, appellant on record. 4. We have recorded the undertaking which was given by Mr. Singh on behalf of the Appellant during course of hearing of this appeal itself. The appellant shall remain bound by this undertaking given to this Court. 5. With the above observations and undertaking as recorded on a separate sheet, this appeal is dismissed as otherwise we do not find any merit in the same. Appeal Dismissed
