Vinay Balachandra Joshi v. Reg. General Supreme Court of India

1996-03-11

B.N.KIRPAL, J.S.VERMA

body1996
JUDGMENT : 1. WP(C) No. 1107/90: There is no surviving challenge now to the allotment made to Ms. Lalita Kaushik, Advocate and Mr. Ajit Puddussery, Advocate-on-Record, who are shown at Serial Nos. I and 2 in the affidavit of Shri A.K. Mahajan dated 7.1.95 at pages 25-27 of the paper-book. However, the grievance survives to the allotment made in favour of Shri D.K. Garg, Shri Pankaj Kalra and Shri Ravi Prakash Gupta shown at Serial Nos. 3, 4 and 5 in the same affidavit. The challenge to the allotment in favour of these three persons is made for the reasons indicated in the remarks column at page 26 of the affidavit. It is appropriate that this grievance is first considered by the Allotment Committee after hearing the allottees and the petitioner - Manoj Swarup. If there be any surviving grievance after the opinion of the Allotment Committee is given on re- consideration of the matter, the matter would then be taken up by the court for consideration. IN ALL THE MATTERS : It is also stated before us that there are about 15 Chambers which are occupied by a single allottee when each of them should have one more allottee according to the rules and that no steps are being taken to make additional allotments of joint allottees in these chambers occupied by single allottees. The Allotment Committee will also examine this aspect. The necessary particulars of such chambers would be furnished by the petitioner to the Allotment Committee. 2. Shri V.B. Joshi, Advocate, would also be heard by the Allotment Committee while considering this matter.
