JUDGMENT 1. - Heard. 2. The applicant along with the co-accused is alleged to have kidnapped Kumari Prem Kanwar. 3. The learned Sessions Judge has referred to statement of Kumari Prem Kanwar recorded Under section 164, Criminal Procedure Code. She has stated that she had left her parental house of her own and had married with the petitioner. The medical age of Kumari Prem Kanwar has though been reported to be 16 yrs. by Board of Doctors, yet, learned counsel for the applicant has shown me the certificate of the Medical officer in-charge, M.G. Hospital, Jodhpur wherein the clinical age of Kumari Prem Kanwar is reported to be 18 yrs. The co-accused are stated to have already been admitted on bail Under section 438, Criminal Procedure Code. 4. Looking to the facts and circumstances of the case it is hereby directed that in the event of his arrest, the applicant shall be released on bail, provided he furnishes a personal bond in the sum of Rs. 10,000/- with one surety of Rs. 10,000/- undertaken to observe the following conditions:- (i) that, he shall make himself available for interrogation by a Police Officer as and when required; (ii) that, he shall not, directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or any Police Officer; and (iii) that, he shall not leave India without the previous permission of the Court.
