JUDGMENT 1. - Heard.In this case, a final report was submitted by the police after investigation into the allegations of rape alleged to have been committed by the complainant upon the applicants. It is further noted that investigating agency had recommended for prosecution of the complainant for the offence Under Section 182 Indian Penal Code. The learned Magistrate, however, took the cognizance of the offence Under section 376 Indian Penal Code and summoned the applicants through non-bailable warrants. 2. It was submitted that only prayer made by the applicants is that learned Magistrate be directed to summon the applicants through bailable warrants. 3. I have looked into the material placed before me. In the facts and circumstances of the case, it is directed that warrants issued by the learned Magistrate shall be treated as bailable warrants. The learned Magistrate shall treat the warrants issued by him accordingly and shall admit the applicants for bail when they surrender before him.Petition Allowed. *******
