JUDGMENT 1. Apart from the question of maintainability of the petition under Article 32 of the Constitution, learned counsel for the petitioner on being asked to point out the specific portions in the decision in Manohar Joshi v. Nitin Bhaurao Paltil and Anr., 1996 (1) SCC 169 , which according to him conflict with any earlier binding decision of this Court or which in any manner tend to restrict the prohibition enacted under sub- sections (3) and (3A) of Section 123 of Representation of People Act so as to permit misuse of the decision for the purpose of seeking votes on the ground of the candidates' religion, wanted some more time to study that decision more carefully. 2. List the matter on 22.3.96, at the request of counsel.
